Nature of the Products Sold
The products sold through GolbyShop.com are primarily made-to-order, customized, or individually produced based on the specifications, finishes, dimensions, or options selected by the customer.
Each product is specially crafted for the order and is not considered a mass-produced item.
Right of Withdrawal
According to Government Emergency Ordinance no. 34/2014 regarding consumer rights in distance contracts, consumers generally benefit from a 14-calendar-day withdrawal period.
However, according to Article 16 letter c) of GEO no. 34/2014, the following are exempt from the right of withdrawal:
“the supply of goods made to the consumer’s specifications or clearly personalized”.
Considering the nature of the products sold through GolbyShop.com, most products are custom-made or personalized, therefore they cannot be returned after the order has been placed and confirmed.
Products That Cannot Be Returned
The following products cannot be returned:
- made-to-order products;
- personalized products;
- products manufactured according to the customer’s specifications;
- products made in individually selected sizes, colors, finishes, or configurations;
- products modified at the customer’s request.
By placing an order, the customer confirms that they understand and accept that the ordered product is specially made for them and cannot be returned under the standard 14-day withdrawal right.
Damaged or Non-Conforming Products
If the delivered product presents manufacturing defects, transport damage, or significant non-conformities compared to the order, the customer is required to submit a notification within a maximum of 48 hours from receiving the product, to the following e-mail address: contact@golbyshop.com.
The request must include:
- the order number;
- a description of the issue;
- clear photos of the product and packaging.
After reviewing the request, the seller may decide to:
- repair the product;
- replace the product;
- fully or partially refund the paid amount, where applicable.
Refusal of Delivery
The unjustified refusal of a package containing made-to-order products does not release the customer from the obligations assumed when placing the order.
Refunds
In approved return or cancellation situations, refunds will be processed using the same payment method used for the purchase or by bank transfer, within a maximum of 14 calendar days from the approval of the request.
